These Terms of Service (“Terms”) apply when you access or use lumibay.com.au (the “Site”) or purchase products from LumiBay (“we”, “us” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Our Store

LumiBay operates this online store using Shopify. Our Site allows you to browse and purchase our products and access information about shipping, returns, care and other services.

2. Eligibility and Acceptable Use

You must be legally capable of entering into a contract to place an order. You agree not to use the Site for unlawful, fraudulent or harmful purposes, interfere with its security or operation, introduce malicious code, scrape or copy the Site without permission, or infringe the rights of LumiBay or any third party.

3. Product Information

We aim to present product descriptions, colours, images, dimensions and other information as accurately as possible. Colours may appear differently depending on your screen or device. Measurements are approximate unless stated otherwise. We may update product information or discontinue products at any time.

4. Orders and Acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges that we have received your order but does not necessarily mean it has been accepted. We may cancel or refuse an order before dispatch where reasonably necessary, including where a product is unavailable, pricing or product information is incorrect, payment cannot be authorised, or we reasonably suspect fraud or misuse. If we cancel an order after payment, we will refund the amount paid for the cancelled item or order.

Please check your contact, billing and delivery information before submitting your order. Contact us promptly if you notice an error. We cannot guarantee that an address or order can be changed once processing has begun.

5. Prices and Payment

Prices are displayed in Australian dollars unless otherwise stated and include applicable Australian taxes where required. Shipping costs and any available delivery options are shown at checkout. You agree to provide current, complete and accurate payment and billing information. Payment is processed by Shopify or the payment provider selected at checkout and may be subject to that provider’s terms.

6. Shipping and Delivery

Orders are processed and delivered in accordance with our Shipping & Delivery page. Delivery times are estimates and depend on the courier service, destination and circumstances outside our reasonable control. International customers are responsible for any applicable duties, taxes or import charges imposed by the destination country.

7. Returns, Exchanges and Consumer Rights

Change-of-mind returns and exchanges are governed by our Returns & Exchanges page. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. If a product is faulty, damaged, unsafe or does not match its description, you may be entitled to a remedy under Australian Consumer Law.

8. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions, eligibility requirements and expiry dates stated with the offer. Unless stated otherwise, discount codes cannot be combined, have no cash value and cannot be applied retrospectively. We may withdraw or correct a promotion where it contains an error or is affected by fraud or misuse, subject to applicable law.

9. Intellectual Property

Unless otherwise stated, the Site and its content—including text, photographs, graphics, product names, logos and designs—are owned by or licensed to LumiBay and are protected by applicable intellectual property laws. 10. Reviews and Other Submissions

If you submit a review, photograph, comment or other content, you confirm that you have the right to share it and that it is accurate, lawful and does not infringe another person’s rights. You grant LumiBay a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our business and marketing. We may remove content that is unlawful, misleading, abusive or otherwise inappropriate.

The Site may include services, applications or links provided by third parties, including payment providers, couriers and social platforms. Their services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services except to the extent required by law.
